Mr. Ronnie Kimble
Your father called
today to request information for you on filing an appeal to the
North Carolina Supreme Court. The Rules of Appellate Procedure
provide that a petition for discretionary review must be filed
within thirty-five days of the opinion of the North Carolina Court
of Appeals. If you are unable to comply with the thirty-five day
deadline, you may file a petition for writ of certiorari without
unreasonable delay. I have enclosed a portion of the appendix to the
Rules of Appellate Procedure as well as a portion of a Style Manual
for you to use as a guide in filing your appeal. You should attach a
copy of the Court of Appeals opinion to the petition, as well as
copies of any other documents you consider necessary for the Court
to understand your appeal. We cannot provide copies free of charge,
so you should make copies of all documents prior to submission to
our Court. You may also wish
to contact one of the following agencies who may be able to assist
you: Prisoner Legal Services, P.O. Box 25397, Raleigh, North
Carolina 27611, Prisoners' Rights Project, UNC School of Law, Van
Hecke-Wettach Hall, CB#3380. Chapel Hill, North Carolina 27599. or
Prisoners' Rights Project, Duke University School of Law, Durham,
North Carolina 27706. Sincerely,
cc: Mr. Ronnie Kimble
