DISCOVERY MEMORDANDUM

(Number 9)

NOW COMES the State of North Carolina and acknowledges receipt of Defendants' request for additional discovery. In addition to the statements of the defendant, Ronnie Lee Kimble previously disclosed, Ronnie Lee Kimble talked to Detective Church on the telephone, shortly after he returned to Camp LeJuene after the funeral which was on October 15, 1995. At that time, Detective Church asked Ronnie Lee Kimble discussed Kimble's activities of October 9, 1995. Ronnie Lee Kimble told Detective Church that he arrived at Lyle's Building Supply in the afternoon, that he waited on a customer, because Ted was busy, then he talked to Steve Swainey, who was working on dog houses, and waited for Ted to get him a saw blade that he needed to cut off the underpinning stakes. That he remembered it was about the time that school was getting out when he left Lyle's and went home.
