Gentlemen:
As I have indicated to each of you in
prior telephone conversations, conflicts with other trials and the
Court's schedule will make it extremely difficult to bring these
matters to trial during the March 2, 1998 term of court.
Therefore, the State of North
Carolina will not oppose your motion to continue. The new trial date
will be selected taking into consideration the information each of
you has provided in regard to scheduling conflicts and vacations.
The remaining pretrial motions should
be heard during the March 2, 1998 term of court.
The first matter for the Court's
attention will be the case of James Silas Paschal. On Monday, March
2nd the court will be required to conduct an in camera hearing to
determine what medical records of the defendant the State of North
Carolina will receive. In order to insure the completion of that
case during this term of court, it is important that the hearing be
conducted on Monday afternoon.
The court has a schedule conflict on
Monday March 9th , and in the morning, Tuesday March 10th
Please be prepared to suggest and
agree upon a date for the hearing of the pretrial motions during the
March 2, 1998 term, which does not conflict with the aforemention
dates.
