RE: Theodore Mead Kimble, and Ronnie Lee Kimble

Gentlemen:

The cases of Theodore Mead Kimble and Ronnie Lee Kimble will be scheduled for April 6, 1998 for the purpose of hearing any pretrial motions. Included in the motions to be heard will be the State's motion to join the defendants and charges for trial and the State's motion for reciprocal discovery as it applies to each defendant. Due to the anticipated length of the case, Judge Beale has indicated that his schedule will not permit him to begin the trial that week.

The trial date will be set by the District Attorney's Office.

In setting a date I will take into consideration any scheduled plans of the attorneys.

Mr. Hatfield indicated that all the attorneys would be ready for and would consent to a trial date beginning on August 3, 1998.

Each of you should notify our office of any conflicts that you have for the terms beginning on June 22, 1998 through August 24, 1998, bearing in mind that the trial, if started during one of those terms, would continue for approximately 6 weeks.

Mr. Lloyd has requested that I pick a trial date and inform him immediately so that he will not be "jerked around". As I indicated to Mr. Lloyd, I will not discuss a trial date with any of the individual attorneys, but I am willing to meet with all the attorneys and discuss the trial date. I will be in the office and available on Friday March 27, 1998. I also have an open schedule on April 2nd and 3rd.

Sincerely,

Richard E. Panosh,
