MOTION TO EXTEND TIME
NOW COMES the defendant above-named, through counsel, and respectfully prays the Court grant him an extension of time in which to file the Record on Appeal and shows the court:

Appointed, undersigned counsel has experienced heavy workloads since
receiving the transcript including jury trials in superior court.
The transcript is 3,152 pages in length and the record will involve
complex issues dealt with in pretrial motions as well as in-trial
argument. Further, counsel has a pending capital trial which he must
prepare for on an ongoing basis. Finally, counsel has conferred with
Assistant District Attorney Richard Panosh who prosecuted this case
for the State of North Carolina, and he has indicated that he has no
objection to an extension of time. 3. For the
reasons set forth above, counsel requests an extension of time for
preparation of the record on appeal for 30 days to 10 June 1999. 4. Pursuant
to Rule 27 of Rules of Appellate Procedure this Court is authorized
to extend time for good cause shown. WHEREFORE, the defendant respectfully prays for this court to order an extension of time to file the record on appeal to 10 June 1999. This the 27 day of April, 1999.
