MOTION TO JOIN OFFENSES

NOW COMES THE STATE OF NORTH CAROLINA and MOVES this Court to join the above referenced cases for trial during this term, pursuant to N.C. Gen.Stat. 15A-926.
 

In support of this Motion, the State alleges:
 

1. That each of these offenses occurred on or about October 9, 1995.
2. That these offenses are based upon the same series of acts or transactions.
3. That these acts are part of a common scheme, to kill Patricia Blakely Kimble, burn her dwelling thus destroying evidence, and collect the proceeds of her life insurance policies.
4. That the State will use the same witnesses to prove each of these cases.
5. That the State has given full discovery in each case.
 

BASED UPON THE AFOREGOING FACTS, the State of North Carolina MOVES this Court to order that these cases be consolidated for trial.
