MOTION TO NORTH CAROLINA COURT OF APPEALS, PURSUANT TO RULES 7(b)(1) and 27(c)(2), FOR EXTENSION OF TIME TO COMPLETE TRANSCRIPT


NOW COMES the undersigned court reporter, pursuant to Rules 7(b)(1) and 27(c)(2) North Carolina Appellate Rules of Procedure, and move the Court for an order extending time for the completion of the transcript of this case.


The trial Court in this matter was the Honorable Preston Cornelius. The trial began on August 3, 1998 and concluded on September 3, 1998. This court reporter reported the case from August 3, 1998 until August 28, 1998, trial time taking 18 days. The defendant has been allowed to appeal as an indigent.
This court reporter received a 30-day extension of time from the trial Court, through February 7, 1999, and an extension from the Court of Appeals through March 24, 1999, and needs additional time (five days) to complete the transcript, due to a two-week illness. It is estimated that the transcript will be completed by March 29, 1999.
 

WHEREFORE, this court reporter moves the Court that an extension of time be granted for the above reason, and that in the interest of justice, an extension of time for preparation of the trial transcript is both appropriate and necessary. The undersigned respectfully requests that the period of time to complete the entire transcript in this case be extended until March 29, 1999.
