THE DEFENDANT'S MOTION TO EXTEND TIME TO FILE RECORD
 

THE HONORABLE NORTH CAROLINA COURT OF APPEALS:
 

NOW COMES the defendant, RONNIE LEE KIMBLE, by and through counsel, and respectfully moves this Court to allow him 30 days extension to file the record in the above-captioned case. As grounds for this motion the defendant shows the Court the following:


1. The above-captioned cases were tried in Guilford County and the murder charge was tried capitally. The trial lasted some five weeks. The transcript was certified as delivered on 6 April 1999 and the time to file the record would ordinarily have expired 35 days thence on 11 May 1999. On April 26, 1999 the Superior Court granted a 30-day extension to June 10 (see attached).
 

2. Appointed, undersigned counsel has experienced heavy workloads since receiving the transcript including jury trials in superior court and a capital habeas corpus petition in federal court. The transcript is 3,152 pages in length and the record will involve complex issues dealt with in pretrial motions as well as in-trial argument. Further, counsel has a pending capital trial which he must prepare for on an ongoing basis.
 

3. For the reasons set forth above, counsel requests an extension of time for preparation of the record on appeal for 30 days to 10 July 1999.


WHEREFORE, for the foregoing reasons, the defendant moves this Court to grant this motion.
